DUBAI, Sept. 23, 2026 : Tenants in Dubai caught in rental deadlock with landlords over proposed rent increases can shield themselves from eviction and default allegations by formally submitting their cheques to the Dubai Rental Dispute Centre through an established judicial procedure known as “Offer and Deposit.”

Tenancy renewals across the emirate often turn tense when property owners demand hikes beyond the thresholds set by the Real Estate Regulatory Agency (RERA) rental index. When negotiations break down, some landlords take a hard line by refusing to accept renewal cheques based on the existing contract value. This leaves tenants at immediate legal risk: under Dubai rental laws, withholding rent—even inadvertently—can trigger a formal 30-day notice followed by eviction proceedings for non-payment.

The Rental Dispute Centre (RDC), the judicial arm of the Dubai Land Department (DLD), provides a direct legal remedy to neutralize that vulnerability. Under the Offer and Deposit procedure, an occupant can formally tender rent cheques or property keys into judicial custody when a property owner rejects direct payment.

“The mechanism allows an applicant to secure a judge’s order to tender rent or surrender premises without determining the wider tenancy rights,” says Dr. Hassan Elhais, Senior Legal Consultant at Amal Alrashedi Lawyers & Legal Consultants. He notes that the filing gives landlords an authorized channel to receive the funds while preserving their standing on any contested renewal terms.

Legal practitioners emphasize that the filing acts as a shield, not an automatic verdict on the rent hike itself. Depositing the previous year’s rate does not establish that an owner’s demanded increase violates regulations, nor does it guarantee a renewal on the tenant’s preferred figures. It purely safeguards the resident from claims of arrears while the substantive legal dispute moves forward.

To initiate the motion, applicants can register directly on the official portal at rdc.gov.ae or visit an accredited Real Estate Services Trustee centre. Submissions require specific documentation:

  • A formal Offer and Deposit motion memorandum in Arabic
  • Valid Emirates ID
  • The most recent registered tenancy contract (Ejari)
  • A proposed tenancy renewal contract matching existing terms
  • Copies of the issued rental cheques alongside written correspondence detailing the landlord’s refusal
  • Trade licence details and designated manager identification if the lease is under a corporate name

All foreign-language evidence must be accompanied by certified Arabic legal translations. Written proof of previous payment attempts—via email trails, registered notices, or electronic messaging—remains critical to satisfy the reviewing judge that the landlord actively declined settlement.

Statutory government fees for filing the motion on the RDC portal stand at Dh70 (comprising a Dh50 application fee, Dh10 Knowledge Fee, and Dh10 Innovation Fee). Those opting to lodge paperwork via Real Estate Services Trustee offices incur an additional processing fee of Dh130 plus value-added tax (VAT).

Once filed, the case is assigned to an RDC summary judge. An approval is not automatic; the judge reviews the documents to ensure the legal thresholds are met. When granted, the applicant deposits the physical cheques or funds directly into the RDC treasury. The judicial body then issues a formal notification to the property owner through official court delivery channels.

Legal consultants caution tenants against relying on personal emails or messaging apps to prove notice. Official service through the RDC system is mandatory to guarantee legal effect.

Once the RDC accepts custody, the tenant is legally deemed to have fulfilled the payment obligation from the date of judicial approval. The money is held securely in the court’s escrow until the landlord claims it or until the RDC’s conciliation department or primary judicial committees settle the broader dispute.

Crucially, an open tenancy dispute does not confer a payment holiday. Rental installments must continue to be tendered as they fall due throughout any formal litigation, ensuring tenants remain compliant under Dubai tenancy legislation.
